It's not over 'til it's over.  The risk of a reversal, a second trial, a reduction in the damages award, the allowance or rejection of an attorney fee award, the granting, modification or denial of an injunction and the delay in "getting to the end" all contribute to having the parties see if a self-imposed resolution makes sense to them.
